Photography/Videography Agreement

This Agreement for Real Estate Photography/Videography service is made between:

The Client, who made the appointment via Aryeo scheduling application.

and

18 Percent Productions LLC,

and is entered into, effective this date upon completion of scheduling.

-Scope of the Agreement-

18 Percent Productions LLC provides the Client with digital images and/or video for the property scheduled via Aryeo scheduling.

The service is scheduled for the time and date proposed by the Client via Aryeo scheduling. The square footage is based off of the Client's completed Aryeo scheduling.

The service includes the photos and/or video of the exterior and interior unless indicated through communication (email, phone, verbal/written communication).

There is an additional $6.00 per mile over 40 mile radius ($3.00 there and back) - (As an example, if 18% Productions had to travel 51 miles to an appointment, a fee of $0.00 for the first 40 miles, $66.00 for the next 11 miles = $66.00 total would be applied from N. Umberland Dr., Lewisville TX (office). Please call if you have any questions about the mileage fee.

18 Percent Productions LLC grants to provide 40*(number) Property photos.

-Responsibilities-

Upon request before the service, 18 Percent Productions LLC can provide instructions on how to prepare the Property for the best results.

The Client is responsible for the adequate preparation of the Property. These preparations include clearing driveway of vehicles, cleaning of all the spaces, cleaning of the pool, cutting of the lawn, and removing any personal items.

It is the Client's obligation to prepare the Property before the arrival of Photographer/Videographer.

In no event is 18 Percent Productions LLC liable for inadequate presentation. 18 Percent Productions LLC is not liable for any lost, stolen, or damaged property.

In the case the Property is not ready at the date upon arrival, 18 Percent Productions LLC has the right to refuse to shoot and keep the non-refundable deposit, or shoot the Property in its current conditions. If 18 Percent Productions LLC agrees and assists with moving items, furniture, anything on the property or cleaning, a $50 fee will be assessed on the final invoice.

It is the Client’s obligation to check the weather before scheduling the shoot.

-Fee/Payment-

The Client will pay 18 Percent Productions LLC a total fee based on square footage and additional services.

Of the total fee, half is required at the signing of this agreement as a non-refundable deposit.

For same day requests and appointments, an additional 30% of the total fee will be assessed as a surcharge.

Payment of the final balance is due upon delivery of final images to Client. If final payment or outstanding balance is not received after 4 days of delivered images, 18 Percent Productions will accrue 10% late fee of the total appointment for every day after the 4th day after delivery.

18 Percent Productions LLC accepts payment through Square.

The Client will reimburse the 18 Percent Production LLC for any reasonable expense with prior approval. These expenses can include travel expenses, extra post-production, high-resolution photos for large prints, or any additional request made before, during or after the service.

-Cancellation Policies-

If Client cancels for whatever reason, 18 Percent Productions LLC collects the non-refundable deposit. If Client cancels appointment within 24-hours of the scheduled shoot, 18 Percent Productions will keep deposit and another appointment will need to be made if applicable. If Client decides to reschedule for a later time & date before 24-hours of the shoot date, the non-refundable deposit can be used for the next upcoming rescheduled shoot. The Client is only able to use the deposit for (1) rescheduled photoshoot. Any additional reschedules after the first reschedule will result in 30% of the total fee as a surcharge.

If cancellation or rescheduling is due to bad weather:

● Until 24-hours before the shoot date, 18 Percent Productions LLC can propose a new date without extra cost.

● Between 24-hours before the shoot date, 18 Percent Productions LLC can propose a new time & date at the extra cost of $25.

● During the service, the Client can request to reschedule the service at the extra cost of $50.

● During the service, if the Client chooses to cancel, the client will be charged 75% of the total fee.

-Delivery-

18 Percent Production grants to deliver digital Property photos, in JPEG format to the Client no more than ____2____days after the shoot. 18 Percent Production grants to deliver video, in MP4 format no more than ____5____ days after the shoot.

If Client requests completed photos to be delivered within 24-hours after shoot, a 30% surcharge will be assessed of the total fee of photos to expedite our services.

18 Percent Productions LLC guarantees that the resolution of the photos will be adequate to the requirements of every MLS service and OTA.

After the final payment, 18 Percent Productions LLC will send the Client an email with a link and instructions about how to download the Photos.

-Rights-

18 Percent Productions LLC remains the only owner of all photos and/or video produced.

The Client is permitted to reproduce, publicly display, and distribute the Photos and/or Video for business purpose and to promote the Property. The Photos and/or Video can't be reproduced by a third-party for purposes.

Any modification of this license must be with the express permission of 18 Percent Productions LLC and may require the payment of additional fees.

18 Percent Productions is permitted to reproduce and distribute the Photos of the Property, with the sole purpose of promoting their own business. 18 Percent Productions LLC is not permitted to give or sell the Photos and/or Video to other parties or distribute them through stock photography channels.

-Disputes Resolution-

Any dispute arising out of this Contract shall be resolved by negotiation.

If Parties are unable to resolve the dispute by negotiation, may be maintained only in court, physically located in 1197 W Main Street, Lewisville, TX 75067, and the Parties hereby consent to the personal jurisdiction of such courts.

(*Community/Park/Pool, etc. extra will be assessed upon availability – if access is not available, drone images of Community/Park/Pool, etc. will be substituted)
