These Terms of Service ("Terms") govern all bookings, shoots, and deliverables provided by 18 Percent Productions LLC ("18 Percent Productions," "we," "us," or "our"), a real estate photography and videography company based in Lewisville, Texas. By booking a session, submitting a request through our website, or otherwise engaging our services, you ("client," "you") agree to these Terms.
If you're booking on behalf of a brokerage, team, or builder, you confirm you have the authority to bind that organization to these Terms.
We provide real estate media services including photography, videography, virtual staging, floor plans, 3D architectural rendering, Zillow 360 tours, and portraits/headshots, as described on our website at the time of booking. Specific inclusions, add-ons, and pricing for each service are set out on the relevant service page or in your booking confirmation.
We reserve the right to update our service offerings, packages, and pricing at any time; changes will not affect a session that has already been confirmed and paid for.
Bookings are made online through our scheduling platform. Sessions can generally be booked up to three months in advance, and we recommend booking early for weekend slots or larger luxury properties that require extra preparation time.
A confirmed booking is one that has received a confirmation email or message from us following your request. Submitting a request does not guarantee a time slot until confirmed.
Pricing for each service is listed on our website and is confirmed at the time of booking. Payment is due at booking or upon delivery, depending on the package selected. We accept the payment methods made available through our booking platform.
Prices are subject to change; the price confirmed at booking is the price that applies to that session.
You may cancel online at any time up until 24 hours before your scheduled session for a full refund. Cancellations made within 24 hours of the session may result in the forfeiture of your deposit.
Each booking includes one complimentary reschedule, provided the request is made before the 24-hour window ahead of your session. Additional reschedules may be subject to availability and a rescheduling fee.
We reserve the right to reschedule a session due to severe weather, safety concerns, or circumstances outside our control, at no charge to you.
The first 40 miles from our Lewisville, TX base is included in standard pricing. Beyond 80 total round-trip miles, a travel surcharge of $3 per mile applies. Weekend sessions (Saturday and Sunday) are subject to a 30% upcharge over standard weekday pricing.
Any applicable travel or weekend surcharges will be reflected in your booking confirmation before you complete your order.
You're responsible for ensuring our crew has safe, timely access to the property at the scheduled time, including any lockbox codes, keys, or entry instructions we may need. If we're unable to access the property or the property isn't ready for photography (e.g., unstaged, unclean, or unsafe conditions) at the scheduled time, the session may be treated as a late cancellation and billed accordingly.
We reserve the right to decline or discontinue a shoot if our crew's safety is at risk.
18 Percent Productions retains copyright ownership of all photographs, video, virtual staging, renderings, and other media we produce. Upon full payment, you receive a non-exclusive, perpetual license to use the delivered media to market the specific property photographed — including MLS listings, print materials, social media, agent or brokerage websites, and builder marketing.
Delivered media may not be resold, sublicensed, or used to market a different property than the one photographed, and may not be used in any way that implies an endorsement by 18 Percent Productions without our written consent.
We may use delivered media in our own portfolio, website, and marketing (including social media) unless you notify us in writing that you'd like a specific project excluded.
Standard delivery is high-resolution JPEG files optimized for MLS upload. Print-resolution or web-optimized file sets are available on request — just let us know at booking. Typical turnaround times are provided at booking and may vary based on package and current volume; we'll flag it if a delay is expected.
You agree not to alter delivered media in a way that misrepresents the property (beyond standard cropping, color, or minor retouching), and not to use our media, name, or branding in any unlawful, defamatory, or misleading manner.
We use Aryeo, a third-party scheduling and booking platform, to manage bookings and payments. Your use of that platform is also subject to its own terms and privacy policy. We aren't responsible for outages or errors originating from third-party platforms we rely on to deliver our services.
To the fullest extent permitted by law, 18 Percent Productions' total liability for any claim arising from our services is limited to the amount you paid for the session giving rise to the claim. We aren't liable for indirect, incidental, or consequential damages, including lost business or lost listing opportunities, arising from delays, technical issues, or weather beyond our reasonable control.
We may update these Terms from time to time. Updates will be posted on this page with a revised "last updated" date. Continuing to book or use our services after changes are posted means you accept the updated Terms. Terms in effect at the time of a confirmed booking govern that booking.
